Media Statement from MOHR on Foreign Employment and Re-Employment

The Ministry of Human Resource recently issued a media statement to clarify on the arising concerns related to the employment and re-employment of foreign workers and trade officers in Malaysia. The Ministry views this approach as a win-win situation for both local job seekers and employers and believes that it will not negatively impact the FDI inflows to the country. A summary of the key points are as shown below:
•    Employers are required to make job vacancy announcement on MYFutureJobs portal for a period of at least 30 days
•    Employers are required to conduct interviews to assess the suitability of local candidates for the advertised position as a precondition in applying for foreign workers or trade officers. 
•    Employers can conduct the interviews either at the employer's premises, during the weekly open interviews organised in SOCSO offices or at the Department of Labour (JTK) nationwide
•    The Ministry WILL NOT interfere in the affairs of the interview session. Employers only need to report the results of the interviews conducted to support the application to employ foreign workers or trade officers.
•    Employers can also use other platforms and channels other than the MYFutureJobs portal to obtain local talent.

The Ministry will issue FAQ and Application Guidelines accordingly before 1 November 2020. Relevant session will be held extensively for employers and employers' unions to provide more details on the process.
